All credit and debit card data are provided directly to our PCI-compliant third-party processor (“Payment Processor”). We do not directly access, handle, or store your credit or debit card data. After completing your transaction, out payment processor provides us with the last four digits of your card number.

·       Retention Period: We retain this information for so long as we keep a business relationship with you; and for so long as required for any other business or legal purposes. We retain the last four digits of our card number for so long as you maintain an account with us; while we keep a business relationship with you; and for so long as required for any other business or legal purpose.

 

c.     Internet Activity

 

·       Examples: Online behavior, interest data, your browser and device information, and your interactions with our websites, applications, systems, and advertisements.

·       Retention Period: We retain this information for so long as we keep a business relationship with you; and for so long as required for any other business or legal purpose.

 

d.     Geolocation

 

·       Examples: We may gather your imprecise geolocation, like your country and city associated with your IP address, as well as location information provide by you in connection with the services being provided by us.

·       Retention Period: We retain this information for so long as we keep a business relationship with you; and for so long as required for any other business or legal purpose.

 

e.     Audio and Video Recordings

 

·       Examples: Images and audio, video or call recordings created in connection with our business activities.

·       Retention Period: We retain this information for so long as we keep a business relationship with you; and for so long as required for any other business or legal purpose.

 

f.      Professional or Employment-Related Information

 

·       Examples: Business contact details in order to provide you our services at a business level or job title, work history, and professional qualifications if you apply for a job with us.

·       Examples: We may retain education information as part of your job application.

We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services, or applications that may be linked to or from the Services. 8.     How do we connect with you on Social Media?

 

We are active on social media, which may include LinkedIn, X, Facebook, YouTube and/or other social media platforms (“Social Media”). Anything you post on Social Media is public information and will not be treated confidentially. We may post (or re-post) on the Site and our Social Media pages any comments or content that you post on our Social Media pages. Your use of Social Media is governed by the privacy policies and terms of the third parties that own and operate those websites and not by this Policy. We encourage you to review those policies and terms. We may use the application programming interface (“API”) services to allow you to access Social Media content from our Site.

 

9.     HOW DO WE HANDLE PERSONAL INFORMATION FROM OUTSIDE THE UNITED STATES?

 

If you access the Site from outside the United States, please be aware that Personal Information may be transferred to, stored in, and processed in the United States. Certain governmental authorities may not consider the level of protection of Personal Information in the United States to be equivalent to that required by the other jurisdictions.

We have implemented commercially reasonable technical and organizational security measures designed to protect the security of the Personal Information we process. If a breach of your Personal Information occurs, we will notify you of the breach if required under applicable law.

 

Although we will do our best to protect your personal information, we do not guarantee the security of personal information. You provide your personal information to and from our Services at your own risk.

 

11.  ANALYTICS AND INTEREST-BASED ADVERTISING TOOLS

 

We use cookies when you use our Site. A cookie is a small text file that our Site saves onto your computer or device when you use the Site that allows the Site to remember your actions and preferences and recognize you or your browser. Web beacons / pixel tags are small graphics on a webpage that monitor your activity when viewing a webpage (together with cookies, “Cookies”).

 

A first-party Cookie allows your web browser to talk to the actual Site that you are visiting (i.e., this Site). A third-party Cookie allows your web browser to talk to a third-party provider providing services or features on the Site you are visiting.

Analytics

To prevent this data from being used by Google, follow the instructions to download and install the Google Analytics Opt-out Browser Add-on for each web browser you use. Using the Google Analytics opt-out browser add-on will not prevent us from using other analytics tools and will not prevent data from being sent to the Site itself or to Google. Opting out will not affect your use of the Site. ·       Google Maps Platform APIs. We may share your information with certain Google Maps Platform APIs (e.g., Google Maps API, Places API). You may revoke your consent anytime by contacting us at the contact details provided at the end of this document.

 

Targeted Advertising

 

·       Social Media Custom Audiences. We may use the remarketing services of certain Social Media on our website to deliver targeted advertisements to website visitors across those Social Meda platforms based on email addresses that we have collected. 12.  YOUr CONSUMER PRIVACY CHOICES

 

Below, we describe ways for you to exercise control over your Personal Data online, generally, and when you interact with us.

 

Update Your Contact Information: You may update your contact information and communication preferences by contacting us as described below.

 

Delete Cookies on Your Browser: Most browsers automatically accept cookies. You can disable this function by changing your browser settings but disabling cookies may impact your use and enjoyment of the Site. You cannot disable all Cookies, such as Cookies that are essential to the functioning of the Site. You can manually delete persistent Cookies, or Cookies that track your activity across websites, through your browser settings.

 

Configure Your Device: The electronic device you use to access the Site may offer additional privacy settings; please see the device settings for details. Please note that even if you opt-out of receiving interest-based advertising, you will still receive advertisements, but they will be more general in nature.

 

Manage Your Cookie Preferences on the Site. When you visit the Site, you can choose whether to enable non-essential Cookies. Please note that some features of the Site will not function if you disable certain Cookies.

 

Consumer Resources: To change your preferences with respect to certain online ads and to obtain more information about third-party ad networks and online behavioral advertising, visit National Advertising Initiative Consumer opt-out page or the Digital Advertising Alliance Self-Regulatory Program. Changing your settings with individual browsers or ad networks will not necessarily carry over to other browsers or ad networks. As a result, depending on the opt-outs you request, you may still see our ads.

 

Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, replying "STOP" or "UNSUBSCRIBE" to the SMS messages that we send, or by contacting us at support@willfully.com. Opting out of marketing messages does not opt you out of service-related messages related to your account, your service requests, or other non-marketing purposes.

14.  TERMS APPLICABLE TO CALIFORNIA RESIDENTS ONLY - INCLUDING YOUR CALIFORNIA PRIVACY RIGHTS

 

Under the California Consumer Privacy Act, as amended including by the California Privacy Rights Act, ("CCPA") California residents have additional rights with regard to their Personal Information. We have provided a summary of those rights below. Please note that these rights are subject to certain exceptions under the law. In the event of a conflict between this Section and the remainder of this Policy, this Section shall take precedence for those California residents. Certain capitalized terms not defined in this Policy have the meanings set forth in the CCPA.

We use or disclose your Sensitive Information, as defined in the CCPA, with our service providers if you apply to receive our financing and insurance services.

 

Subject to certain limitations such as (a) exceptions permitted by applicable law and (b) verification of your identity, you may exercise the following rights with regard to your Personal Information:

 

Rights to Know or Access Your Information

 

California residents have a right to access any of the following which occurred in the prior 12-month period:

  • The specific pieces of Personal Information that we have collected from you;

  • The categories of Personal Information we collected from you;

  • The categories of sources from which the Personal Information was collected;

  • The categories of third parties to whom we have disclosed your Personal Information;

  • The categories of Personal Information that we Sold or disclosed for a Business Purpose and the categories of third parties to whom it was disclosed for a Business Purpose; and

  • The Business or Commercial Purpose for collecting, sharing, or selling your Personal Information.

 

Right to Deletion

 

You have a right to request that we delete the Personal Information we collected from you.

 

Right to Correct Your Information

 

You have a right to request that we correct your inaccurate Personal Information. If you request that we correct inaccurate Personal Information about you, we will use commercially reasonable efforts to correct it. If necessary, we may ask that you provide documentation showing that the information we retained is inaccurate.

 

Right to Data Portability

 

You may request a copy of the Personal Information you previously provided to us in a portable and, to the extent technically feasible, readily usable format.

 

How to Exercise Your California Privacy Rights

 

To exercise your rights described as California consumers in this Policy, you may submit your request to us by:

Who May Exercise Your Rights. You may only make a request to exercise your rights on behalf of yourself. A parent or legal guardian may make a request on behalf of their child. A person that you authorize to act on your behalf may make a request related to your Personal Information. If you choose to use an authorized agent, you must (a) provide signed permission to that authorized agent to submit requests on your behalf, and (b) verify your identity. We may deny a request from an authorized agent if we do not have proof that they are authorized by you to act on your behalf.

 

Verifiable Consumer Request. To verify your request, you must provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information, and you must describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. To verify your identity, we may ask you to provide additional information, or log into your online account, if available.  Any information you provide will only be used to verify your request. When seeking additional information from you, we may contact you through the contact phone number or email address you provided in your request. If we cannot verify your identity, we may deny your request.

 

When We Will Respond. We will try to respond to your request within 45 days. If we require additional time, we will inform you of the reason and extension period. Any disclosures we provide will only cover the 12-month period preceding our receipt of your request.

 

Notice of Right to Opt-out of Sale/Sharing

 

California residents may direct us not to sell or share your Personal Information at any time (this is your right to “opt-out”).

 

Honoring Opt-out Preference Signals. California residents may opt out by sending an Opt-Out Preference Signal, such as the Global Privacy Control (“GPC”) on the browsers or extensions that support such a signal. If you choose to use the GPC signal, you will need to turn it on for each supported browser or browser extension you use.

 

You may also submit your opt-out request by:

If you are a California resident using an authorized agent to exercise your rights to opt-out of the sale of Personal Information, you must (a) provide signed permission to that authorized agent to submit requests on your behalf, and (b) verify your identity. We may deny a request from an authorized agent if we do not have proof that they are authorized by you to act on your behalf. 

 

Right to Non-Discrimination

 

You have a right to not receive discriminatory treatment for exercising any of your rights under the CCPA. If we choose to offer a financial incentives program in the future, additional terms will apply which may be an exception to this Section.

 

Shine the Light.

 

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided above.
